Terms & Conditions

1. Scope of Application

1.1 These Terms & Conditions apply to all contracts for the supply of goods concluded between BumpHeaven (the “Seller”, “we”, “us”) and customers (“you”, “Customer”) via our online store.

1.2 These Terms apply exclusively. Any conflicting or supplementary terms proposed by the Customer shall not apply unless expressly agreed in writing.

1.3 A “Consumer” is any individual acting for purposes wholly or mainly outside their trade, business or profession, in accordance with the Consumer Rights Act 2015.


2. Contract Formation

2.1 The presentation of products in our online store constitutes an invitation to treat, not a legally binding offer.

2.2 By placing an order via our checkout process, you submit a binding offer to purchase the goods contained in your shopping basket.

2.3 A contract is formed when we:

  • confirm acceptance of your order by email; or

  • dispatch the ordered goods; or

  • request payment after your order has been placed.

2.4 We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors or supply issues.

2.5 Order processing and communication are conducted primarily by email. You are responsible for ensuring that your email address is correct and able to receive our messages.


3. Right to Cancel (Cooling-Off Period)

3.1 Consumers have the right to cancel their order within 14 days from the day they receive the goods, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

3.2 To exercise your right to cancel, you must notify us clearly via email or our contact form.

3.3 You must return the goods within 14 days of notifying us of cancellation.

3.4 Return shipping costs are borne by the Customer, unless the goods are faulty or incorrect.

3.5 We reserve the right to reduce the refund amount to reflect any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


4. Prices & Payment

4.1 All prices displayed are in GBP (£) and include applicable UK taxes, unless stated otherwise.

4.2 Delivery costs (if applicable) are displayed separately during checkout.

4.3 We accept payment via the payment methods displayed in our store, including but not limited to Shopify Payments, card payments and other third-party providers.

4.4 Payment processing is handled by external payment service providers. We do not store payment details.

4.5 We reserve the right to suspend or cancel orders where payment is reversed, disputed or charged back.


5. Delivery & Shipping

5.1 We deliver to the United Kingdom only, unless stated otherwise.

5.2 Orders are typically processed within 48 hours and delivered within 5–10 working days after dispatch. Delivery times are estimates and not guaranteed.

5.3 Risk of loss or damage passes to the Customer upon delivery to the address provided.

5.4 If delivery fails due to incorrect or incomplete address details provided by the Customer, we are not obliged to issue a refund or replacement.

5.5 Where a parcel is marked as delivered by the courier, it shall be considered successfully delivered. We are not liable for loss after confirmed delivery.


6. Retention of Title

6.1 Ownership of the goods remains with the Seller until full payment has been received.


7. Faulty or Non-Conforming Goods

7.1 Goods must be as described, fit for purpose and of satisfactory quality under the Consumer Rights Act 2015.

7.2 If goods are faulty, damaged or incorrect upon arrival, you must notify us within a reasonable time and provide supporting evidence where requested.

7.3 We reserve the right to offer a repair, replacement or refund, depending on the circumstances.

7.4 Normal wear and tear, misuse, improper care or failure to follow care instructions are excluded from liability.


8. Liability

8.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

8.2 Subject to 8.1, our liability is limited to foreseeable losses arising directly from a breach of contract.

8.3 We shall not be liable for indirect, incidental or consequential losses, including loss of profit or business interruption.

8.4 Our total liability shall not exceed the purchase price of the goods giving rise to the claim.


9. Force Majeure

We shall not be liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to logistics disruptions, customs delays, strikes or supplier failure.


10. Governing Law & Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

10.2 The courts of England and Wales shall have exclusive jurisdiction, subject to mandatory consumer protection laws.


11. Alternative Dispute Resolution

11.1 We are not obliged to participate in alternative dispute resolution procedures.

11.2 Consumers may seek assistance via recognised UK consumer advice services if required.
